MOTOR DEALER and/or SALESPERSON: CANEM INVESTMENTS LTD. dba CANEM AUTO SALES/CANEM AUTO GROUP (BURNABY) (Dealer #10781) AND PRADEEP "PAUL" SINGH (Salesperson #12861)
ISSUE:
- Consumer claimed dealer and salesperson did not declare damage over $2,000.00 – deceptive act.
- Purchase agreement showed there was such a declaration.
- Evidence also showed that the dealer informed the consumer of the extent of the damage.
- Evidence showed inconsistencies in the consumer’s evidence and that he was in fact aware of damage prior to purchasing the vehicle.
OUTCOME:
- The dealer and the salesperson were found to not have committed a deceptive act.
- Claim against the dealer and salesperson were dismissed.
