MOTOR DEALER and/or SALESPERSON: VANCOUVER AUTO LIQUIDATION CENTRE (Dealer #30656) AND JOHN RICHARD UFNAL (Salesperson #110418)

ISSUE:

• On November 29, 2007, Dealership was called to a hearing before the Registrar of Motor Dealers for infractions under the Motor Dealer Act and the BPCPA.
• On November 29, 2007, Mr. Ufnal was called to a hearing before the Registrar of Motor Dealers regarding his salesperson application. This hearing is combined with his employer, Vancouver Auto Liquidation Centre.
• November 29, 2007 hearing was adjourned with a 2008 hearing date to be scheduled.
• Continuation of November 29, 2007 hearing was held on February 6, 2008.

OUTCOME:

• Registrar’s decision at the November 29, 2007 hearing was that the hearing be adjourned until an early 2008 hearing date can be scheduled and both dealer and salesperson are to attend.
• Registrar’s decision at the February 6, 2008 hearing was that the dealership be levied an administrative penalty of $1000 plus investigation costs subject to the Administrative Penalty Notice.
• Registrar's decision at the February 6, 2008 hearing was that the Salesperson be issued a two year conditional licence and is to work at the same dealership for that time period.
