ENFORCEMENT ACTIVITIES - REGISTRAR OF MOTOR DEALERS 2008 COMPLIANCE DECISIONS

THE BUSINESS PRACTICES AND CONSUMER PROTECTION ACT S.B.C. 2004 c.2

COMPLAINANT: KRISTEN HATT AND HILARY VIRK AND CHAD MARKUS

MOTOR DEALER and/or SALESPERSON: THE EIGHT BALL CAFÉ LTD. dba S&G MOTORS (Dealer #30401) AND STONEY GRANT BIDDLE (Salesperson #10570)

ISSUE:

  • Dealership and Salesperson were called to a hearing before the Registrar of Motor Dealers for infractions under the Motor Dealer Act and the BPCPA.

OUTCOME:

  • The Registrar's decision at March 19 hearing was to suspend the Dealer Licence and the Salesperson Licence.
  • Dealer levied administrative penalty under BPCPA for investigation costs of $2,000.00 and to reimburse consumer $12,500.00 plus 12% interest for one year.
  • Since the hearings, the Motor Dealer has closed its business and is bankrupt. There is however, $20K available from a letter of credit the Motor Dealer had previously provided to the VSA which will be used to make payments to the clients. Any remaining funds are to be applied to the VSA’s investigation and hearing costs and if there are still funds available after the claims have been paid out, remaining funds are to be applied to the administrative penalties.
