ENFORCEMENT ACTIVITIES - REGISTRAR OF MOTOR DEALERS 2010 COMPLIANCE DECISIONS

COMPLAINANT: REGISTRAR

MOTOR DEALER and/or SALESPERSON: D-L MILLS AUTO GROUP (Dealer #30741)

ISSUE:

  • On or about December 23, 2009, a financial institution called the VSA with concerns that the motor dealer had not paid out liens on consumer purchased vehicles.
  • The preliminary investigation by the VSA determined that the dealer was not maintaining and occupying its registered business premise.
  • Evidence also indicated the dealer may have sold consumer vehicles on consignment when not authorized to do so, and has failed to pay those consumers.
  • Evidence also suggested that the dealer admitted he was effectively closed.

OUTCOME:

  • Considering the VSA investigation is at a preliminary stage, the real possibility of consumers being adversely affected and the potential of consumers making compensation fund claims, the Registrar determined it was in the public interest to suspend the motor dealer’s registration until the investigation is concluded and any compensation fund claims are considered.
  • The matter will be brought back before the Registrar once the investigation is complete and any compensation fund claims are considered by the Compensation Fund Board.
