- Park Shore obtained a deposit from Mr. Sangra.
- Mr. Sangra did not complete the deal as agreed.
- Park Shore refunded all but a small amount to cover its costs.
- Claim was a deceptive act.
OUTCOME:
- Claim dismissed.
- Mr. Sangra’s son-in-law brought the claim and lacked standing to do so.
- Evidence showed Mr. Sangra subsequently agreed to Park Shore keeping $800 – no evidence to the contrary.
- No evidence of deception on the part of Park Shore Motors Ltd. was found.
