IN THE MATTER OF THE MOTOR DEALER ACT R.S.B.C.1996 C.316 AND
THE BUSINESS PRACTICES AND CONSUMER PROTECTION ACT S.B.C. 2004 c.2

COMPLAINANT: ROBERT LAMONTAGNE AND TRACY LAMONTAGNE

MOTOR DEALER and/or SALESPERSON: BILL HOWICH CHRYSLER LTD. (Dealer #9332)

ISSUE:

  • Dealer admitted to failing to disclose damage over $2,000.00.
  • Consumers made many claims regarding losses such as depreciated value and repairs amounting to over $12,000.00.
  • Dealer disagreed with the amount of the consumers’ claims.

OUTCOME:

  • Consumers proven loss was only $313.52 and dealer ordered to pay that amount.
  • Necessity of hearing not only due to dealer’s conduct – dealer ordered to pay only half the investigation and hearing costs.
  • Dealer ordered to pay a small administrative penalty.
