MOTOR DEALER and/or SALESPERSON: THREE POINT MOTORS LTD. (Dealer #5053)
ISSUE:
- Operating with unlicensed salespeople, including the dealer principal
- Failure to ensure salespeople complete the Salesperson Certification Course in a consistent and timely fashion
- Consistent ambivalence toward licensing procedures
- After the dealership assured the Registrar, at a November 22, 2005 hearing that compliance would be pursued, the hearing was adjourned until February 16, 2006
- Prior to the February 16 hearing, the dealer principal notified the MDC that he would be out of the country and unable to attend
- The dealership was not represented at the hearing
OUTCOME:
- The Registrar imposed an administrative assessment of $5,000 for failure to have salespeople licensed, and a further $5,000 for the dealer principal’s failure to appear at a scheduled hearing.
- The dealer eventually complied with all licensing regulation.
- Following legal representation and negotiation, Three Point Motors paid a reduced administrative assessment of $5,000.
