ENFORCEMENT ACTIVITIES - REGISTRAR OF MOTOR DEALERS 2005 COMPLIANCE DECISIONS


FILE NUMBER:

HEARING DATES: October 18, 2004 and February 16, 2005

IN THE MATTER OF THE MOTOR DEALER ACT R.S.B.C. 1996 C.316

COMPLAINANT: REGISTRAR

MOTOR DEALER and/or SALESPERSON: MAIN STREET AUTO LTD. (Dealer #9039) AND DICK MAIN (Salesperson #103450)

ISSUE:

  • Failure to have licensed salespeople on the premises
  • Dealer requested exceptions because literacy issues made it difficult if not impossible to complete the Salespersons Certification Course

OUTCOME:

  • The Registrar refused to grant exceptions, explaining that comprehension of the law and complex contracts is a requirement, irrespective of personal inadequacies
  • A conditional licence was issued, a period of grace during which salespeople were expected to become fully compliant.
  • Regular licences were eventually achieved.
