ENFORCEMENT ACTIVITIES - REGISTRAR OF MOTOR DEALERS 2008 COMPLIANCE DECISIONS

THE BUSINESS PRACTICES AND CONSUMER PROTECTION ACT S.B.C. 2004 c.2

COMPLAINANT: REGISTRAR

MOTOR DEALER and/or SALESPERSON: VALLEY AUTO SUPPLY LTD. (Dealer #25513)

ISSUE:

  • Pursuant to Section 6 of the Motor Dealer Act, the dealer was called to hearing on July 19, 2007 for failure to abide to suspension order. It was alleged that the dealer was operating in contravention of current suspension order.
  • Dealer license currently suspended since February 2006.
  • It was the Registrar’s decision that the suspension of the dealer licence remains in place, and that the hearing be adjourned to a future date to be determined.
  • Continuance of hearing from July 19, 2007 held September 27, 2007.
  • Continuance of hearing from September 27, 2007 held on October 25, 2007.

OUTCOME:

  • At the September 27, 2007 hearing the Registrar's Decision was that the dealer sign an undertaking, renew dealer licence and salesperson licence of Brian Dilling. New hearing date will not be necessary if dealer complies with decision beforehand.
  • At the April 16, 2008 hearing, the Registrar's Decision was that the dealer licence remains suspended pending payment of penalty and update of licensing issues.
