COMPLAINANT: REGISTRAR
MOTOR DEALER and/or SALESPERSON: MEDALLION MOTORS LTD. (Dealer # 10941) AND DAVID STICKLAND (Salesperson #105506)
ISSUE:
- Dealer and Salesperson called to hearing for salesperson working without valid licence, failure to provide records, failure to notify of change of address, failure to maintain and occupy business premise and failure to hold valid business licence from local municipality. David Stickland attended on behalf of self and dealership.
- Pursuant to Sections 5 and 6 of the Motor Dealer Act, Mr. Stickland was called to a hearing before the Registrar of Motor Dealers on May 21, 2008 to review his salesperson application.
OUTCOME:
- The Registrar's decision at the July 19, 2007 hearing was to suspend the Motor Dealer Licence of Medallion Motors Ltd effective immediately; dealer directed not to sell any vehicles to retail customers - can sell wholesale only The licence was to remain suspended until such time as all outstanding matters as addressed in the hearing are resolved and the dealer appears at a hearing before the Registrar of Motor Dealers at a time and location to be determined.
- Hearings reconvened and continued for Medallion Motors Ltd. and Mr. Stickland September 27, October 25 and November 29, 2007 where the dealer licence remained suspended, matters remained unresolved and Mr. Stickland’s licence lapsed/cancelled.
- The Registrar’s decision at the May 21, 2008 hearing was to cancel the Salesperson Licence of Mr. Stickland and Compliance Order and Notice of Penalty filed with the Supreme Court.
