THE BUSINESS PRACTICES AND CONSUMER PROTECTION ACT S.B.C. 2004 c.2

COMPLAINANT: Registrar of Motor Dealers

MOTOR DEALER and/or SALESPERSON: CASCADE RV SALES & RENTALS (Dealer #9948)

ISSUE:

  • The motor dealer did not comply fully with Section 11 of the Motor Dealer Act – “A motor dealer must, subject to the applicable zoning and other bylaws of the municipality or regional district that has jurisdiction, maintain and occupy an established business premises identified by a sign naming the dealer as set out in the dealer’s licence, where he or she must keep and maintain records of the business.”
  • Dealer has also made a request for a licence for Consignment Sales

OUTCOME:

  • The motor dealer met the requirements necessary to obtain a business licence from the Township of Langley.
  • The Registrar has granted the dealer 60 days to provide a Letter of Credit for his Consignment Sales Licence.
