- Consumers claimed deceptive act by dealer in describing vehicle options that did not exist.
- Consumers claimed deceptive act by dealer in describing a price benefit where one did not exist.
- Consumers claimed deceptive act by dealer in promising to take back vehicle and refunding the purchase price.
OUTCOME:
- Consumers were aware of the non-existence of the options prior to purchasing the vehicle.
- Consumers misapprehended the price benefit based on their own faulty research and assumptions.
- Consumers did not rely on any promises to return the vehicle and getting a refund.
- Claim against the dealer was dismissed.
